These terms, conditions, covenants, undertakings, rules and the privacy policy (collectively herein, for the sake of brevity referred to as “T&Cs”) and other terms and conditions as may be stipulated by Sewakzone Services (Hereinafter, in short referred to as the “Company”) from time to time are applicable to all/any person, whether individual, incorporated or unincorporated entity booking/procuring products and/or services via the Company’s mobile application (App)or otherwise or any other medium such as website etc. run and operated by the Company.
The App and website are owned and operated by the Company and all rights, title, interests including all intellectual property rights in the App and website vests with the Company. Company reserves the sole right to modify the T&Cs at any time.
The terms 'we', 'us' and 'our' refers to the Company and its affiliates and assignees and the term 'you' refers to person/persons using the services of the company, visiting the Website or any other medium operated and/or controlled by the company and/or availing/procuring services on these mediums. Words denoting singular in these Terms & Conditions means plural and vice versa. Words denoting one gender means any applicable gender.
The terms Housemaid / Home Cook / Housekeeper Cum Cook / Childcare Governess /Elderly care Nurse / etc. represents service providers. Please note that these service providers are in no way related to the company, neither are they employed by the company. They are independent people seeking employment / work through our platform.
By accessing or using the website, booking/procuring any services, you agree that the Terms & Conditions as in force from time to time shall apply to you and be legally binding on you.
The use of the Website by an Employer or a household or a company shall be deemed acceptance of an agreement to these terms only.
Sewak Zone Services is a hiring platform. The website has been established to allow an Employer (household) to contact Employees domestic help listed with our platform as job seekers for the purpose of employment.
The workers profiles listed / registered with us are job seekers. The information concerning skills and experience is provided by the job seeker and it is taken by us on good faith. As an employer you are supposed to check and satisfy yourself regarding the skills and suitability of the candidate. We do not issue any experience certificate to our registered members or endorse their skill / experience.
Our full fee is due to us at the end of trial period of 2 days once the domestic worker is placed at your household.
Cooling Period - We offer a 10 day cooling period after the receipt and clearance of our full placement fee. Wherein if a worker placed by us leaves within 10 days after the full payment is made to us we will replace the worker for free. (If a client opts for a refund in this period our refund policy will apply. The visitors / users of the site are advised to please check the refund policy for a better understanding)
We would try to match the workers’ skill as per your requirement but it is necessary that you meet, interview and convince yourself / your family members about the candidates suitability and select the candidate yourself. We will only help with the search and interview process.
Our warranty is subject to validation, which is by making full payment of our fees due to us at the end of trial period 2 days after placement of the worker.
The warranty is not valid where the worker is leaving due to unfair labour practices / unfair treatment or breach of contract / understanding with the employee / worker.
We are a Hiring Platform - Sewak Zone Services will not involve itself or its employees / associates for resolving issues arising between the employer and the employee / service provider (domestic help etc.) during the course of employment / term of the contract or even beyond. If any kind of issue with regards discipline or overall conduct of the worker hired through Sewak Zone Services arises it is supposed to be resolved among yourselves or you are advised to take the course of Law.
Non Discrimination Policy
Sewak Zone Services is an equal opportunity platform and while registering workers it does not discriminate among job seekers (maids, drivers, other service providers etc.) on the basis of religion, race, caste, sex, place of birth, descent, sexual orientation, gender identity, disability, age.
Sewak Zone Services also strictly prohibits the users of our website www.mychores.in from discriminating on the basis of religion, race, caste, sex, birth place, descent, sexual orientation, gender identity, disability, age or any of them. Sewak Zone Services will not tolerate any adverse discrimination against any person on its platform, premises, whether that person is in its employment or otherwise.
Replacement- Subject to the below conditions, Sewak Zone Services undertakes to replace domestic help by us with a suitable domestic worker willing and able to fulfil the same tasks and duties as in the original job contract within 72 hours. However this is subject to availability of workers. The maximum time taken could extend from 7 days to 25 days
We will try to match the skills of the replacement worker with the initially placed worker, however we do not guarantee that the replacement worker will have exactly the same personality traits and attributes as the one selected in first case.
We provide maximum of one replacements for up to one year from the time of placement of the first worker at no extra charge if the worker leaves the job without any valid reason or does not prove satisfactory in his/ her work.
The replacement provided will have the same Job description and timings and hours of work as mentioned and filled in the job specification form during placement of the first maid / worker.
Any change in the specification of replacement worker from the original Job specification form calls the agreement null and void. In case of changes in job description a new agreement with new specification has to be signed to take the process any further. (Charges will be applied)
The salary expectations of replacement worker could be higher than the originally hired worker due to changed market conditions. We will not be responsible for replacements or refunds in cases where the customer is refusing to pay the prevalent salary rates.
We will not be responsible for a replacement or a refund if the worker leaves the job due to unfair labour practice, verbal abuse, physical abuse or and other abuse to the worker.
We will not be giving replacements in cases where the worker leaves the job because of changes in job description as against the agreed job description at the time of hiring.
Salary dues of the existing maid has to be cleared before we take up replacement request. No replacement request will be entertained where the salaries of the maid hired through us is pending or due or withheld for any reason.
In cases where we fail to provide a replacement within 25 days we will issue you a credit note to the extent of 50% of placement fee which can be redeemed against any of our services within one year.
We will try to match the skills of the replacement worker with the initially placed worker, however we do not guarantee that the replacement worker will have exactly the same personality traits and attributes as the one selected in first case.
Contract is valid for one year and is renewable every year by paying the placement fee for the category as listed.
In cases where the worker is not police verified we will initiate the police verification only after the placement of worker after the trial period of 2 days and after payment of full fees due to Sewak Zone Services. Police verification will be done only where the requisite documents are available with the worker; we are not liable if the police verification is not done due to lack of documentation with worker. The time taken for police verification is not in our control and can extend up to 45 working days.
If in cases where the worker leaves the job due to any reason you are liable to pay the salary for the number of days he / she has worked with you.
You are liable to pay salary to the domestic worker for the trial period.
Refund Terms & Conditions: Our clients are advised to check our refund terms. All refunds will be as per the refund policy.
Company without any obligation may at its sole and absolute discretion provide references regarding the workers previous work place.
Any services as availed/booked by you through the Company and also by any other medium operated by the company are after due diligence. However, the company will not be liable or responsible for any act of omission or commission on behalf of the individuals provided/deputed by the company.
You shall be solely liable to ensure that you are lawfully entitled to book/avail such products/services and that you shall use the product(s)/service(s) for only legitimate purposes. You shall also ensure that in no event there exists any condition or situation at the place where service is to be provided that may pose any risk or hazard to the suppliers.
Company does not endorse and shall not be responsible for any act(s)/omission(s) of the individuals rendering service(s) to you as booked through the company website. You shall not hold the Company liable for any act, error, omission, breaches or negligence of or by any individual including deficiency, unsatisfactory or delayed performance of services or for any personal injuries, death, or other damages or expenses resulting therefrom or from the use of services by you. Company without any obligation may at its sole and absolute discretion, try and resolve any dispute between you and the individual engaged by you.
Company gives you limited non- exclusive, non-licensable, revocable, non-transferrable right to use the website to just book the services listed therein and in no event you shall have any right or license over the App or website including to download, copy, modify or use it any other manner.
You shall be responsible for making full and final payment(s) for the service(s) booked/availed by you within the stipulated time. Payment shall be due immediately upon your use of the service(s). In addition there may be fees applicable to you as per the fees structure and taxes and other charges which you may be liable to pay in connection with the services.
You shall indemnify and hold the Company harmless for any loss, action, damages arising to the Company due to your acts/omissions/violation of any third party violation.
These Terms & Conditions and all matters arising out of the use of company’s products and/or services shall be governed by, construed and interpreted in accordance with the laws of India, and you hereby consent to the exclusive jurisdiction of courts at Gurgaon.
Cleaning Services Terms & Conditions
Thanks for using our services ("Services"). The Services are offered by Sewak Zone Services by using our Services, Customers are agreeing to these terms. Each Service is distinct in nature so service specific terms and conditions (including environment, health, and safety measure) together with these terms and condition forms entire understanding between the "Customer" and the "Company". PLEASE READ THEM CAREFULLY.
Service conditions are applicable subject to the realization of payment from the Customer.
The order once booked and paid in full is neither cancellable nor transferrable.
The scope of works limited to all interior areas accessible with standard cleaning aids. The Company Representative will not clean inaccessible and unsafe places.
The Customer understands that the Services will be provided at the premises registered at the time of order booking.
Customer agrees to provide necessary access to their premises for our company representative/technicians for rendering services.
Customer agrees and understands to arrange necessary permission wherever applicable and confirm prior to the job commencement.
Pre and post cleaning inspection need to be carried out by the customers in the presence of technicians and if any corrections are needed, should be made on the same day.
Any unsatisfactory services need to be reported within 24 hours of the service delivery. The company will not be held responsible for any complain after 24 hours of service delivery.
All valuables including cash, jewellery, items of sentimental value, art, antiques must be kept safe and secured before Company Representatives’ arrival. We shall not be held responsible if any valuables are lost.
We do not move or clean heavy objects, electronics goods cabinets or similar item. If needed, Customer needs to arrange at their own cost.
Cabinets, Cupboards and Storage areas will not be cleaned from inside, if it need be, Customer has to empty such places for our team to clean such places.
Precaution must be taken to remove/cover food stuff while cleaning the premises to prevent contamination with chemical.
Services do not include cleaning of bio hazard materials and wastes, or Human/animal excrement.
Sewak Zone Services reserves the rights to change the price unless the customer has paid in full.
Customer agrees to cooperate if actual time required at the location is more than the standard time
We reserves the right not to be responsible for delay for a cleaning visit due to act of god, traffic congestion, postponed service due to broken equipment, job not complete due to lack of hot water or power and suitable cleaning materials, third party entering or present at Client's premises obstructing the cleaning process.
Customer is not entitled for any refund in part or full once the service is delivered.
Except as expressly stated in this Agreement, the Service Provider makes no other warranties, express or implied. Your co-operation is necessary to deliver good service.
Note: Sewak Zone Services shall not by any means be or become liable to the customers for any damage suffered by them directly or indirectly through the presence of pest in the premise contracted. The only liability of Sewak Zone Services will be limited to re-treat the said premises against the pest for which customer has signed the contract with Sewak Zone Services.
Police Verification
The primary responsibility of police verification is that of the worker and is a matter between the employer and the worker. Given the difficulties faced by the workers to get this done themselves we facilitate and help with the process. We are not obligated to do the Police Verification in anyway. In cases where we fail to get the police verification of the worker done due to unavailability of worker’s documents or any other reasons, a refund to the customer will be initiated as per the company’s refund policy. We are in no way responsible or liable in any way with any losses / liabilities / damages arising out of any situations where in a worker placed by us is police verified / unverified / failed police verification. Please take note of the following points regarding police verification:
Police verification will be facilitated only if the required documents are available with the worker placed
Police verification is an online process which takes a minimum of 21 day to 45 days and is entirely dependent on the dates given by the police department and the worker making it on time.
To initiate the police verification a letter will be required from your end addressing us to get the police verification done for the worker placed at your home with her details. (Employment letter required by police department)
Note - Sewak Zone Services strongly recommends police verification of every domestic worker hired through its platform. The police department also recommends that police verification should be completed for all domestic workers.
